I'm not sure about the USA, but in Canada, when you buy a VCR tape, there's a small tax on the tape that is then placed into a pool and then channeled back by the appropriate rights agency to the media companies. So in a round about way you are paying for the content.
I know most media organizations, given a choice, would want to make home VCR taping illegal. There was that big lawsuit against Sony years and years ago, trying to get them to remove record buttons from their VCRs.
That said, there isn't a hill of moral difference for the end user between downloading and taping. However, ultimately those who don't hold the copyrights aren't technically free to distribute the works of others in any manner they see fit. MP3.com ran into that trouble too. They had this plan to copy CDs and put them online. The idea was you'd register with MP3.com as to which CDs your actually own. Then you could listen to those MP3s from CDS you really own via their web site. Of course they were sued like crazy and lost.
I think Penn said he ultimately doesn't mind people sharing his BS show as it creates more P&T fans who then come and pay $75 to see them in Vegas.
